1. Acceptance of Terms

By accessing or using ForayMail ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you do not have permission to access the Service.

2. Description of Service

ForayMail provides an email automation and cold outreach platform designed for B2B sales and marketing. This includes email sequencing, account warmup, unified inbox management, and analytics. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Acceptable Use & Anti-Spam Policy

You agree not to use the Service to send spam, unsolicited bulk email, or any material that violates the CAN-SPAM Act, GDPR, or any other applicable anti-spam laws. You must have explicit consent or a legitimate legitimate business interest to contact recipients.

We actively monitor usage and reserve the right to immediately suspend or terminate accounts found to be engaging in spam, phishing, or abusive behavior without refund.

4. Account Responsibilities

You are responsible for safeguarding the password and API keys that you use to access the Service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

5. Subscriptions and Billing

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (Billing Cycle). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select.

A valid payment method, including credit card, is required to process the payment for your Subscription. Payments are processed securely via Stripe. We do not store your full credit card details.

6. API Integrations (Google / Microsoft)

ForayMail allows you to connect your Google Workspace or Microsoft 365 accounts via OAuth. By doing so, you grant ForayMail permission to send emails, read incoming replies, and manage your inbox on your behalf strictly for the purpose of providing the Service. ForayMail's use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

7. Limitation of Liability

In no event shall ForayMail, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
